Prosecutor Marcelo Ferreira de Souza Netto, from the Public Ministry of , recommended that the Court give an injunction prohibiting the construction company Tenda from proceeding with construction on Avenida Guilherme Dumont Villares, in Butantã, in the west zone of São Paulo.
Authorized by Ricardo Nunes (MDB) management, the work began on Wednesday (26). The permit includes 384 trees on site.
In his statement, the prosecutor states that the administrative process was processed without the possibility of public consultation, with signs of infringement of the principles of transparency and defense and preservation of the municipality’s territory and natural resources.
The authors of the request were federal deputies Luciene Cavalcanti, state deputies Carlos Giannazi and councilor Celso Gianazzi, all from PSOL. They also demand the presentation of an environmental impact study by the construction company, which is reinforced by the promoter’s statement.
He concludes by stating that the elements presented by the authors show that it is possible that the authorization given by the city hall is “illegal and harmful to the environment”, and that is why he suggests that the Court grant the injunction.
As a report from the Sheetthe mayor’s management () and the construction company signed a TCA (Environmental Commitment Term) that provides for the cutting of trees, including the 128 native ones.
There, the company is expected to build four towers with nine floors each — there will be more than 700 apartments measuring 31 and 33 square meters, in the so-called Max Vila Sônia.
In compensation, the company must plant 221 seedlings of native species in the same region. According to the city hall, replanting should only be done after the completion of the works, which have not yet started.
In addition, Tenda is expected to donate around R$2.5 million, equivalent to the price of 530 seedlings, to the Special Fund for Sustainable Development, linked to the Municipal Secretariat for Green and Environment.
The money can be used for the city to create gardens on sidewalks and improvements in green areas, such as parks.
When contacted about the start of the cuts, Tenda said that the project for the Max Vila Sônia project was duly approved by the city hall, with regular processing with the Housing and Green and Environment departments.
“It should also be noted that the approval process included tree compensation through planting in the project itself and with the Special Environmental Fund, as determined by Municipal Legislation”, states the note.
PROTESTS AND CONTROVERSY
The Agreement. In Alto da Lapa, for example, one protests against the Nunes administration’s approval for the construction company Tegra to remove 118 trees from the project and build residential buildings.
The land was part of Unisal (Centro Universitário Salesiano de São Paulo), which sold it to the construction company in May 2024.
