Tarcísio complained to Fachin about tax benefits for Refit and pointed out losses to SP – 11/27/2025 – Panel

The governor of , (Republicans), had a meeting with the president of the Federal Supreme Court, Edson Fachin, on October 28, in which he complained about an injunction from the Rio de Janeiro Court of Justice that benefited the.

At the meeting, which was also attended by the State Attorney General, Inês Coimbra, the São Paulo government presented data that estimated the impact of the suspension of tax collection to Refit at R$360 million per month.

The central argument was that the Rio court injunction interfered with São Paulo’s tax autonomy and allowed the continuation of practices considered irregular by the state tax authorities.

The day after the meeting, Fachin accepted the governor’s request and overturned the court’s decision, which authorized Refit to stop collecting tax on sales destined for the state. He also reestablished the requirement to collect ICMS and authorized the resumption of tax actions.

Fachin justified that the TJ-RJ measure represented a risk to the administrative order and the public economy.
