Rapporteur sees state collusion in fuel fraud – 11/29/2025 – Panel

Rapporteur of the project that toughens penalties for , the deputy (MDB-RS) states that fraud involves public agents and defends that the text be voted on in a coordinated manner with three other projects on the same theme.

Moreira was announced as the project’s rapporteur this Thursday (27) in the same tweet as the president of the Chamber, (Republicanos-PB),: which punishes the stubborn debtor, which guarantees access by the (National Petroleum, Natural Gas and Biofuels Agency) to invoices in the fuel chain and which creates the National Fuel System Operator.

For Moreira, the frauds involve the collusion of the State. “I mean, it’s impossible to carry out this fraud without a public agent involved,” he says. “They all have a public agent involved in the process and almost 100% of the operation in the country is carried out by drug trafficking. In fact, we are working with crime that works with the mass economy.”

He makes an analogy with the National Social Security Institute and states that the strategy used is to earn a little on each sale of adulterated fuel to generate a huge amount of money.

“Fuel, due to the volume that is consumed in Brazil, any adulteration generates a mountain of resources and enriches many people”, he continues. “Drug trafficking is involved in this, but he is involved in such a way that he owns the refinery, he bought the ethanol plant, he bought thousands of stations. They are absolutely installed and today this has become the main income”, he says.

He recalls that the topic gained attention following the outbreak of the , carried out in a coordinated manner by the Federal Revenue, Federal Police, Public Ministry of São Paulo and the São Paulo PM. The action identified links between the (Primeiro Comando da Capital) and the fuel sector and the financial market, and carried out search and seizure actions in Faria Lima.

The deputy says he will look into the dosimetry of the sentence, the topic of the project for which he is rapporteur, at the beginning of next week. “It’s a more complex matter, you have to have advice to see what penalty is appropriate for each crime. Take a gas station that defrauded the sale of fuel. Immediately set up your process, see who is responsible, and then see the penalty. Will there be deprivation of liberty? Will he be arrested. Will there be a financial fine? The gas station will be sealed”, he states.

Moreira argues that the ideal is to approve projects in a coordinated way because the texts are complementary. In the parliamentarian’s opinion, voting in isolation would reduce the effectiveness of the proposals.

“These legal instruments generate legal certainty and absolute monitoring capacity over the system to prevent consumers from consuming adulterated products without having the slightest idea”, he states.
