“A good judge is the one who doesn’t show up”, says Mendonça about TSE in the 2026 elections

Minister participated in an event this Monday and defended the impartial performance of the Electoral Court in the elections

Mendonça stated that “politicians” are the “main actors” in the elections

The minister, from the STF (Supreme Federal Court), stated this Monday (1st) that “a good judge is one who does not appear” when defending the impartial action of the TSE (Superior Electoral Court) during the elections. The judge made the statement at the Arko Talks Brasil 2026 event, by Arko Advice and Galapagos Capital, in São Paulo (SP).

During his speech, Mendonça stated that “politicians” are the “main actors” in the elections. He also said that the role of ministers is not to “modulate” the process “according to the rules of the game” aiming to “improve the rule of law”.

Despite not being mentioned by name in the statement, Mendonça exchanged barbs at other times with the minister, who presided over the Electoral Court during the 2022 election.

COMPOSITION OF THE TSE

The TSE is made up of seven full ministers. There are three from the STF, two from the (Superior Court of Justice) and two jurists appointed by the Presidency of the Republic after a nomination from the Supreme Court.

The TSE Plenary chooses its president and vice-president from among those appointed by the STF. The mandate lasts for two years and the person elected can be reappointed for another two years. Currently, the minister presides over the Electoral Court.

Mendonça will assume the vice-presidency of the TSE in 2026, when the minister will become president.
