Elisa Mouliaá requests three years in prison for Íñigo Errejón for a continued crime of sexual abuse | Spain

The actress Elisa Mouliaá has presented an indictment against Íñigo Errejón in which she requests that a trial be opened and that the former deputy, after an anonymous accusation of sexist violence, be sentenced to three years in prison for a continued crime of sexual abuse.

In her indictment, to which Europa Press has had access, the actress asks that the former politician be sentenced to compensate her with 30,000 euros “for moral damages” and for the “damages suffered as a result of the sexual abuse.” Likewise, it requests that a separate civil liability case be opened against the accused, as well as that bail be required to be paid and, if it is not paid, that steps be carried out to find out his financial situation.

Íñigo Errejón, who denies the facts, appealed against his prosecution for an alleged crime of sexual assault that he had committed against the actress one night in October 2021, understanding that there were no “minimal indications” of guilt. His defense maintains that the procedures carried out during the investigation phase “rule out the existence of even minimal signs of criminality and corroborate the complainant’s invented story.”

Judge Adolfo Carretero agreed, in an order issued on November 14, to prosecute the former deputy for an alleged crime of sexual abuse against the actress. In the indictment, after an account of the events, the judge states that “there being no eyewitnesses to the events and having some reference testimonies and expert evidence, the main evidentiary evidence is the statement of the injured party.”

In that same letter, Carretero insisted that it was not up to his court to determine whether the version of the actress or that of Errejón is credible or not, but rather to a sentencing court: “The evidence exists and has not been totally distorted by the version of the investigated person, his expert and documentary evidence, so the procedure cannot be archived in this instance, under penalty of the investigating judge taking over the role of the judge.”

It all happened one night in September 2021. They had both attended a party together and the 40-year-old politician sexually assaulted her by kissing her without her consent when they were going up in the elevator and, later, he put her in a room of the house and touched her numerous times without her consent, even removing “his virile member.” Afterwards, they drove to Errejón’s home and there he tried to have sexual relations again, at which point she criticized his behavior and reproached him for making her feel uncomfortable and violated.

The possible three crimes against sexual freedom on an ongoing basis occurred after she attended the presentation of a book by Errejón [el expolítico presentó Con todo. De los años veloces al futuro en el Círculo de Bellas Artes de Madrid el 22 de septiembre de aquel año]; a meeting in which he, according to the victim, “always maintained a correct attitude.” At that time, both did not know each other personally, although they had been exchanging messages for a year through the social network Instagram and the instant messaging application Telegram. At the end of the public event, she invited him to go together to a party that two friends of the actress were holding in an apartment in Madrid.
