The councilor of Belo Horizonte (PT), great-nephew of the former president (PT), filed a lawsuit in the Federal Court of the capital of Minas Gerais to request the suspension of the benefits of the former president (PL) as there is no law as a former president deprived of liberty.
The action was filed at the Civil Court of the Judiciary Section of Belo Horizonte. The document cites reports that showed that Bolsonaro, even through , continues to have access to four servers for security and support activities, two official vehicles with drivers and two commissioned advisors.
The former president also has related administrative expenses — tickets, daily allowances, fuel and vehicle maintenance.
According to the text, the law does not contemplate, “under any circumstances, the situation of a former president who was criminally convicted and deprived of liberty.” The action continues and says that the decree that regulates the law “was based on the assumption that the former head of state would remain in public life, suffering specific risks, moving around, participating in commitments and carrying out activities that justified logistics, security and advice”.
“Once arrested, none of these grounds remain,” he continues. “The maintenance of civil servants, advisors and official vehicles for an individual deprived of liberty constitutes a misuse of purpose, since the structure funded by the State is intended to protect former heads of State in civil activity, not people incarcerated without participation in public life.”
The councilor also speaks of damage to the treasury, due to “spending without a public cause, without a constitutional purpose and without any use for society”.
