The Seville Prosecutor’s Office has filed the (Amama) complaint about an alleged deletion of mammograms in the Andalusian Health Service (SAS) considering that there is no evidence of a crime of discovery or disclosure of secrecy and computer damage as reported by the entity.
The prosecutor determines that an “avalanche of requests” caused the system to stop functioning normally, it never occurred and there was never a crime, according to what was announced this Tuesday Abc and sources from the Prosecutor’s Office have confirmed to EFE.
Amama’s complaint was later joined by the Patient Advocate, ensuring that documents containing confidential information about the health and treatment of those affected had been destroyed. They denounced the existence of possible crimes of infidelity in the custody of documents, damage to privacy and lack of integrity in the exercise of public office.
For the Prosecutor’s Office, none of these crimes have occurred, which is why it has decided to archive the proceedings, since “no direct evidence of intentional manipulation has been found and that the downfall of servers has been the result of their saturation, as they were not able to provide access to the number of requests for viewing the images corresponding to the citizen service module,” according to the text of the file cited by the newspaper.
It also highlights that the clinical data contained in the medical history of the complainants “are complete, authentic and coincident” and “there is no technical or documentary evidence that there has been an intentional deletion, a human manipulation error or a decision contrary to established clinical procedures.”
The president of Amama, Ángela Claverol, filed a complaint with the Prosecutor’s Office on October 21 to denounce the alleged deletion of medical records from the platforms of the Andalusian Health Service (SAS). The Minister of Health, Antonio Sanz, denied it.
The alleged deletion, which this group understood could constitute crimes such as obstruction of justice, was detected a couple of weeks earlier by women who had come to the association after the problems detected in the breast cancer screening program. According to Claverol, some tests such as mammograms or ultrasounds have disappeared from platforms such as Clic Salud or Diraya, and the nomenclature change has also been detected in some of them, actions that the Prosecutor’s Office has now rejected.
