Alcolumbre demands respect from the STF after Gilmar’s decision – 12/03/2025 – Power

The president of , (União Brasil-AP), demanded respect from the (Federal Supreme Court) to the Legislature and spoke of changing the Constitution in response to the minister’s decision against impeachment proceedings.

“It is unreasonable for a law voted in two Legislative Houses and sanctioned by the President of the Republic to be reviewed by the decision of a single minister of the STF. To this end, a collegial decision must be required”, said the president of the Senate. He mentioned a PEC (Proposed Amendment to the Constitution) that restricts monocratic decisions, that is, decisions taken by a single Supreme Court minister.

“The established situation indicates the need to change the regime of so-called monocratic decisions, especially those that preventively suspend the validity of laws”, declared the senator.

Alcolumbre stated that the decision goes against what is foreseen in the legal system. Gilmar determined that only the Attorney General of the Republic can propose impeachment of Supreme Court ministers. He considered unconstitutional an article in the Impeachment Law that allows any citizen to suggest a process of this nature – the conduct of which is up to the Senate.

“Possible abuses in the use of this right cannot lead to the annulment of this legal command, much less through a judicial decision,” said the president of the Senate, referring to the growing number of requests for impeachment of STF ministers.

He further stated that only a legislative change can alter rules of this nature, “under penalty of a serious constitutional offense to the separation of Powers”. He also mentioned the possibility of the Senate voting on a bill that changes the provisions on crimes of responsibility.

“If it is true that this House and its Presidency have deep institutional respect for the STF, it is also true that, in this relationship, there is effective reciprocity, and that the Judiciary’s respect for the Legislative Power, its constitutional prerogatives and the legitimacy of its decisions is equally genuine, unequivocal and permanent”, said Davi Alcolumbre.
