Processing at the STF is considered the “last move” for City Hall to prohibit use before regulation
The president of the Federal Supreme Court, Edson Fachin, sent minister Alexandre de Moraes a case on the regulation of motorcycle taxis in São Paulo. The action, proposed by the Solidariedade Party, questions the decision of the São Paulo Court of Justice that allowed the capital’s City Hall to adopt measures or prohibit the paid transport of passengers by motorcycles.
The action was aimed at Moraes after Fachin understood that the minister already has, under his report, another similar action: the constitutionality of the State Law that regulates the use of the service. The legislation was decreed unconstitutional by Moraes.
Now, the São Paulo City Council sees the action proposed by Solidariedade as the last hope of legislating on the matter. Recently, on a public agenda, the mayor of São Paulo, Ricardo Nunes, made an appeal to Moraes, recalling a video of the minister, when he was Secretary of Public Security of São Paulo, rejecting the use of motorcycle taxis via apps.
If Moraes does not give a favorable opinion to the ban, Nunes is considering putting regulations into practice before December 10th, when the service could start operating again. The measure would be tougher and more restrictive than companies want, imposing, for example, three-month training for drivers; minimum of three years of category A license and mandatory applications to share the data of all registered motorcyclists with the public authorities.
