The president of , (União Brasil-AP), criticized the federal government and said, this Wednesday (3), that the House does not usurp its prerogative when evaluating the (Federal Supreme Court). Messias is at risk of being rejected because Alcolumbre and other senators wanted Lula to have chosen (-MG).
He said he has been under attack since the announcement of the Messiah’s name. According to the president of the Senate, this happens because he defends the prerogatives of the House. The President of the Republic appoints ministers to the Supreme Court, but those chosen only assume the position if they are approved by the majority of senators.
“At no time did any of us, senators, attempt to usurp the prerogatives of the President of the Republic to nominate a member of the Federal Supreme Court,” said Alcolumbre.
He mentioned that refusing a name for the Senate is the right of the Senate. He also cited the fact that no nominee has been barred since the end of the 19th century.
“‘Ah, but because it hasn’t happened in 134 years [rejeição]the Federal Senate wants to usurp the prerogative of the President of the Republic’. Never. But everyone fulfills their obligations and maintains their prerogatives. The president has the prerogative to nominate, the Senate has to debate and vote. And then yes, endorse, yes or no, that indication”, he declared.
Alcolumbre stated that he had scheduled the decisive vote on Messias for December 10 so as not to be accused of postponing the decision. The senator said that the time between the announcement of the nomination and the final deliberation was decided based on the average of other votes by authorities.
In 2021, the senator was president of the CCJ (Constitution and Justice Commission) and was criticized by .
The Lula government, however, did not send the documents necessary for the hearing to the Senate after the announcement. The idea was to have the power to postpone the decision if it was not found that Messiah would be rejected. Alcolumbre criticized the tactic.
“I need to know now if all those criticisms that were made against the former president of the CCJ are valid today, for government authorities”, declared the president of the Senate.
Alcolumbre complained about campaigns that placed the National Congress as an enemy of the people – rhetoric that appeared, for example, . The speech came mainly from government sectors.
The president of the Senate mentioned the PEC (proposed amendment to the Constitution) that Congress approved at the end of 2022, before Lula’s inauguration, to provide money to the elected president to fulfill his campaign promises. He also cited the fact that the current President of the Republic won the dispute for Planalto by a narrow margin.
“We had the capacity and institutional maturity never seen in the history of this country to deliver a transition PEC in 25 days to a president of the Republic who was just elected, not with 70% of the votes, but with 51%”, declared the president of the Senate.
At the end of his speech, Alcolumbre gave a statement directed both to the government and just the STF. The senator is in agreement with the Supreme Minister’s decision against impeachment requests initiated in the Senate. In practice, Gilmar’s movement removes power from the Legislature.
“What I just wanted, from all the other Powers, was for them to deal with [o Legislativo] in the same way that this president who is speaking to you treats the other Powers. No unfounded aggression, no attacks and no offense. And many times, on other sides, that’s not what we receive here”, he declared.
The president of the Senate had already spoken earlier this Wednesday, when he mentioned the possibility of changing the Constitution as a response to Gilmar’s movement.
