Minister Flávio Dino, of the STF (Supreme Federal Court), accompanied Minister Alexandre de Moraes, in a vote this Wednesday (3), to condemn five of the seven officers of the PMDF (Military Police of the Federal District), who are responsible for omission during the acts of January 8, 2023.
The trial takes place in the plenary session of the First Panel of the STF and, as a result, just one vote is enough for the panel to have a majority and convict the five defendants and acquit two.
In the rapporteur’s vote, Moraes considers the penalty of 16 years in prison and 100 days’ fine worth 1/3 of the minimum wage, in addition to the loss of public position in the military police for five.

Of the seven, Moraes and Dino voted to acquit the defendants: Flávio Silvestre de Alencar e Rafael Pereira Martins.
According to the reporting minister, the former PMDF leadership acted with omission in the face of a widely known and anticipated risk scenario.
According to him, warnings about the possibility of violent acts were abundant and formally reached the security authorities of the Federal District days before January 8th.
A for attempted violent abolition of the Democratic Rule of Law, coup d’état, damage qualified by violence and serious threat, against the Union’s assets, and with considerable damage to the victim, deterioration of listed assets, for violation of the contractual duty of guarantor and for interference with the norm.
While all defendants denied the charges and argued for acquittal in court.
Now, the trial still needs the votes of minister Cármen Lúcia and minister Cristiano Zanin. The case will be closed on Friday (5).
