Dino defends Gilmar’s decision that makes it difficult to impeach STF ministers

Minister of the Federal Supreme Court (STF) Flávio Dino defended this Thursday (4) the injunction granted by Minister Gilmar Mendes that changes the rite and makes the impeachment of court ministers more difficult.

For Dino, the decision proposes updating the “old law from 1950” and is due to the attacks that the STF has been suffering, especially Minister Alexandre de Moraes.

“The central issue is not the existence of checks and balances, but misrepresentation when there is an excess. The 81 requests, evidently, are an obvious excess. Just remember that the champion is just one minister: Alexandre de Moraes. He responds for half of these requests. Either he is a ‘serial killer’, or a victim of persecution”, said the minister. “There’s too much shouting and not enough reflection.”

In the Senate, there are 81 impeachment requests being processed. Of this total, 66 refer to current ministers, considering requests that deal with members of the Court individually and other collectives.

In the injunction, Gilmar removed “every citizen” the right to report a crime of responsibility against a STF minister. According to the decision, the complaint will only be filed with the Attorney General’s Office (PGR).

Furthermore, the quorum for the removal of a minister was changed to two-thirds of the Senate (54 of 81). Until then, the process of impeaching a STF judge progressed by a simple majority of votes.

Throughout his participation in the Jota Forum, Dino highlighted that it was necessary to “balance the vertices of the architectural triangle designed by Oscar Niemeyer and Lúcio Costa”, highlighting that this was a collective task. He also stated that he does not see Brazil in a catastrophic phase, arguing that the country has lived through more difficult times and could not consider the current scenario as one of institutional chaos.

The minister also compared the Brazilian situation to that of countries in the Organization for Economic Cooperation and Development (OECD) to reinforce that, despite problems, the Powers have fulfilled their role.

Dino also defended that harmony between them must be built daily, just like in a marriage or stable union, not in an a priori way, but in dialogue and mutual commitment. According to the judge, this spirit of permanent dialogue should also guide the Supreme Court.
