Dino says there is an excess of impeachment requests to the STF – 12/04/2025 – Power

The minister of the (Supreme Federal Court) said this Thursday (4) that there have never been so many requests from members of the court in the Senate and that the biggest target of these requests, is the victim of persecution and blackmail.

Dino was questioned at the Fórum Jota event, in Brasília, about the minister’s individual decision against opening impeachment proceedings. This determination will be evaluated by the court plenary next week.

He responded that he would not anticipate his vote, but that “there is a factual framework that challenges normativity”. “We have 81 requests for impeachment against Supreme Court ministers. This has never happened before in Brazil and this has never happened in any country on planet Earth,” he stated.

According to him, the decision deals with a relevant legal issue and was only taken now because there have never been so many requests for impeachment.

“I hope this judgment serves as a stimulus to legislate on the matter,” said Dino.

“The central question [do julgamento] it is not checks and balances, but rather the distortion of that, when there is excess. The 81 requests are an obvious excess. Just remember that the champion is just one minister: Alexandre de Moraes. So, either you take care of a serial killer or you take care of someone who is the victim of a type of persecution, of blackmail”, he added.

He also refuted criticism that the Supreme Court’s main decisions are individual and says that its determinations on, for example, parliamentary amendments, have been approved by the collegiate body.

“Do you see how a sloppy debate leads to this type of understanding? The idea that the Supreme Court’s most important decisions are monocratic is false,” he said.

Gilmar suspended this Wednesday (3) sections of the document dealing with the removal of ministers, in a preliminary (provisional) decision that helps to protect members of the court.

“You have a certain positioning movement, mainly in the Senate, regarding the possibility of impeaching Supreme Court ministers,” said Motta.

He defended the need for independence and harmony between the Powers. “When there is this interference, it is always very bad. The reaction yesterday to Minister Gilmar’s decision was a decision in which the Senate took a position contrary to what Minister Gilmar stated in his preliminary decision”, he stated.

“I think and believe that the Supreme Court itself will, together with the Senate, through dialogue, find a path to conciliation for this situation.”
