Motta criticizes interference from Powers and shielding in the STF – 12/04/2025 – Power

The president of , (-PB), stated this Thursday (4) that the decision of the minister of the (Supreme Federal Court) to undergo an impeachment process is a result of political polarization and criticized the interference between Powers.

“You have a certain positioning movement, mainly in the Senate, regarding the possibility of impeaching Supreme Court ministers,” said Motta at Fórum Jota, an event in Brasília.

He defended the need for independence and harmony between the Powers. “When there is this interference, it is always very bad. The reaction yesterday to Minister Gilmar’s decision was a decision in which the Senate took a position contrary to what Minister Gilmar stated in his preliminary decision”, he stated.

“I think and believe that the Supreme Court itself will, together with the Senate, through dialogue, find a path to conciliation for this situation.”

Motta also added that there cannot be what he called institutional radicalization or a “tug of war” between the bodies.

Gilmar suspended this Wednesday (3) sections of the document dealing with the removal of ministers, in a preliminary (provisional) decision that helps to protect members of the court.

The Impeachment Law dates back to 1950, and Gilmar considered it incompatible with the Constitution, for example, an article that allows any citizen to file a complaint against Supreme Court magistrates. The Senate is responsible for conducting the process.

According to the minister, this responsibility belongs solely to the head of the (Attorney General’s Office), currently in charge of . The process would continue to be processed in the Senate, but Gilmar decided that a greater proportion of senators would be needed to open it.
