Novo wants to file a proposed amendment to the Constitution (PEC) to ensure that anyone can request the impeachment of a minister of the Federal Supreme Court (STF) and to require an absolute majority quorum in the Senate to open the impeachment process.

“Again, some Supreme Court ministers try to demean and usurp the function of the Legislative Power, without any constitutional justification. This PEC is a means to re-establish normality and balance between the Powers”, emphasized Marcel van Hattem (Novo-RS), leader of Novo in the Chamber.

The party has been collecting signatures since this Wednesday, 3rd, after a preliminary decision by STF minister Gilmar Mendes that changes the rite and makes it more difficult to impeach court ministers.

In the injunction, Gilmar removed “every citizen” the right to report a crime of responsibility against a STF minister. According to the dean’s decision, the complaint will only be filed with the Attorney General’s Office (PGR).

Furthermore, the quorum for the removal of a minister was changed to two-thirds of the Senate (54 of 81). Until then, the process of impeaching a STF judge progressed by a simple majority of votes.

“The practice of impeachment of ministers, when used in an abusive or instrumentalized way, is not limited to an attack on individuals, but is configured as an attack on the structure of the Rule of Law itself”, argued Gilmar.
