The (Federal Audit Court) filed, this Wednesday (3), a request to monitor the government’s hiring of an Italian law firm with the aim of monitoring the extradition process of the federal deputy (PL-SP).
The representation to the court had been made by federal deputies Gustavo Gayer (-GO) and Coronel Meira (PL-PE). They attached press reports that stated that the (Attorney General’s Office) had closed the deal for R$200,000.
The TCU ministers, however, considered that information provided by the AGU made it clear that the hiring was carried out on an urgent basis. Furthermore, they said that it had relevant results for monitoring and carrying out the necessary actions for the deputy’s extradition, “which is why there are no signs of irregularities”.
The parliamentarians had argued to the court that the AGU’s actions in the context would go beyond its competence and constitute a misuse of its functions.
The TCU, however, stated that the body is allowed to hire private firms to defend national legal interests, as long as legislative procedures are followed.
The ministers added that it would be disproportionate to require AGU to act directly in foreign forums, as this would presuppose that the body has in-depth knowledge of the legal systems of all national states with which Brazil has a diplomatic relationship.
According to the TCU, union lawyers would also have to have specific professional qualifications in these states, similar to the requirement to register with the OAB on Brazilian soil, requirements that would lack proportionality.
Furthermore, they stated that the attorney general informed that the contract was carried out by the Ministry of Foreign Affairs at the request of the body, due to an order issued by the Federal Supreme Court.
the minister ordered that he accompany her in the extradition process, after officially informing the STF about her extradition.
“Considering the communication of the arrest of the convicted defendant Carla Zambelli Salgado de Oliveira in the Italian Republic, please inform the Attorney General of the Union to monitor and adopt the appropriate and necessary measures related to the defendant’s extradition process”, says the minister’s order.
The deputy fled the country via Argentina and the United States before landing in Italy. She was convicted of participating in the invasion of the (National Council of Justice) system.
This Tuesday (2), the deputy’s rapporteur released an opinion defending the acquittal of the deputy, who is imprisoned in Italy, where she is in Brazil.
Therefore, next week, the commission must vote on the report. Afterwards, there will be deliberation by the plenary of the Chamber — a majority of 257 votes is needed for Zambelli to lose his mandate.
