Airbnb is condemned after woman falls from balcony and becomes paraplegic

O TJDFT (Court of Justice of the Federal District and Territories) condemned the to reimburse all medical expenses of a woman who became paraplegic after falling from the balcony of a property rented by the platform. The decision can still be appealed.

The woman sued the court in January this year, after the accident which, according to her, was caused by structural flaws in the . The fall of a parapet left the paraplegic victim.

Although the first instance rejected the request due to the lack of concrete evidence of the causal link and the payment of a partial insurance payment, the accident victim’s appeal mentioned the consumption ratio and the objective liability of the platform.

The judge, upon recognizing the allegations and the risk of harm to health, partially granted the anticipation of the request, which determined that all proven monthly medical expenses must be reimbursed from the date of the decision, upon presentation of invoices, instead of the preliminary deposit that had been requested.

A CNN Brazil contacted the platform for a position on the case, but has not received a response so far. The space remains open.
