The former advisor to the Presidency asked minister Alexandre de Moraes, of the (Supreme Federal Court), this Thursday (4), for authorization to follow in person his trial in the coup plot process, in Brasília.
Martins lives in Ponta Grossa (PR) with a series of restrictions since he was released from prison by Moraes in August 2024, and cannot leave the city.
Defendant accused of having contributed to the writing of the so-called coup draft, he is part of a group whose trial will begin on Tuesday (9) and should end on December 17.
“The accused’s personal attendance at procedural acts of a decisive nature represents not only a legitimate expression of interest, but also the full exercise of a constitutionally guaranteed subjective right”, says the legal document, signed by lawyers Jeffrey Chiquini and Ricardo Scheiffer Fernandes.
According to the defenders, Martins’ intention to appear “is not guided by provocation or vanity”.
“The authorization now requested represents a minimum gesture of restoration of the procedural humanity that must accompany, in any hypothesis, the exercise of criminal jurisdiction”, they state.
The lawyers also ask that Martins not be held responsible for any images of him being released by the press, as he is prohibited from exposing himself in interviews or on social media. They also provide details of the flight to and from Brasília and the hotel you intend to stay at.
The former advisor had permission from Moraes to attend the session in which he became a defendant, in the first semester.
