Four of the seven ministers in the trial voted for ineligibility, counting from the 2024 election. The majority supported the rapporteur, Claudio José Langroiva Pereira, due to his ineligibility.

In the decision, Pereira called Marçal’s cuts strategy “innovative” and “forbidden.” “The social engineering strategy, developed by the appellant, is truly innovative in the context of Brazilian elections, but it is also prohibited, either due to the impossibility of control (even by its organizers) and inspection; or due to the offer of remuneration to individuals, to promote candidacy”, he pointed out.

The court understood that the championships held by the then candidate, with the offer of prizes and with , violated the legislation, which prohibits the granting of economic advantages to natural persons for broadcasting electoral propaganda on the internet.

Confirmation by a collegiate body makes the businessman ineligible for the next elections, in accordance with the Clean Record Law. However, an appeal can be made to the (Superior Electoral Court).

The trial in the second instance began on November 6, but was suspended upon request from Judge Regis de Castilho. The judge denied, this Thursday, the misuse of the media and ineligibility, but was defeated.

For Rafael Carneiro and Felipe Corrêa, lawyers for PSB, one of the proponents of the action that led to ineligibility, this Thursday’s decision is important to guarantee the fairness of the electoral process.

“The judgment reaffirms the Electoral Court’s commitment to complying with the rules that guide the dispute, demanding essential standards of correctness and transparency from everyone. Respect for the rules remains central to the credibility of elections and the legitimacy of democratic choices,” they said in a statement.
