In conversations this Thursday (4), STF ministers () adopted a tone of indignation when commenting on what was presented by the Attorney General’s Office, led by , which asked it to reconsider its decision that helps shield members of the court against .
Gilmar from AGU also this Thursday.
To interlocutors, ministers close to Gilmar assessed Messias’ stance as a betrayal against the one who was his main coordinator among the magistrates in the search for a vacancy.
Now, they say, President Lula’s (PT) chosen one should have even more difficulty in getting support for his candidacy in the Senate, where there are parliamentarians very close to the magistrates.
Ministers stated in these conversations that, in their assessments, Messias tried to take advantage of the friction between the Senate and Gilmar to gain the support of senators in his campaign to obtain approval for his nomination.
He ignored, however, the strain that this would generate for the minister, who had been working insistently to overcome resistance from colleagues like and to his name.
Moraes supported the senator (-MG), who was also the favorite of the president of , (União Brasil). Dino, in turn, fell out with Messias when they were both part of the PT government.
The chronology of the process was also highlighted in the conversations by the ministers, who highlighted that Gilmar asked for a statement from the AGU in the process on September 30th and the response was only presented now, in the midst of Messias’ campaign for a place on the STF.
In his decision, Gilmar states that only the head of the (Attorney General’s Office), currently in charge of , can file a complaint to open proceedings against Supreme Court magistrates.
The reaction in the Senate was immediate. In a note, the president of the Senate, Alcolumbre of the court, spoke of changing the Constitution to defend the prerogatives of the Senate if necessary.
In the statement rejected by Gilmar, he asked that the decision have its effects suspended until the definitive judgment by the STF plenary.
