Senate CCJ should discuss PL that updates impeachment law on Wednesday

The Senate Constitution and Justice Committee is expected to discuss, next Wednesday (10), the bill that updates the impeachment law. The decision is a response to the decision by Minister Gilmar Mendes, of the Federal Supreme Court (STF), which restricted the possibilities of impeachment of STF ministers.

The information was confirmed to Broadcast Politico by the president of the CCJ, senator Otto Alencar (PSD-BA), responsible for preparing the collegiate’s agenda. There is a possibility that senators will request a review (a regulatory maneuver to guarantee more time and postpone the vote), which would postpone the analysis of the proposal until the next session.

The bill is from 2023 and was prepared by a commission of jurists created by the then president of the House, Rodrigo Pacheco (PSD-MG). The president of the commission was the then STF minister Ricardo Lewandowski, currently Minister of Justice under President Luiz Inácio Lula da Silva. After the committee presented the text to the Senate, it was up to Pacheco to formalize the bill at the time.

The proposal’s rapporteur is senator Weverton Rocha (PDT-MA), one of the closest allies of the current president of the Senate, Davi Alcolumbre (União Brasil-AP). The expectation is that he will present the report on Monday, the 8th.

Gilmar Mendes’ decision

Last Thursday (4), the minister requested the Attorney General’s Office (AGU) to reconsider the monocratic decision that restricted the Attorney General of the Union’s prerogative to present impeachment requests against ministers of the Supreme Court.

The dean classified the request as “manifestly unappealable”, justifying the refusal by the fact that the AGU’s questioning was not presented in the appropriate procedural manner. The Attorney General’s Office had requested the suspension of the effects of the minister’s decision until the Court analyzed the processes in question.
