A Union Military Justice converted, this Saturday (6), the prison of the soldier Kelvin Barros da Silva in preventive. The soldier confessed to having killed the corporal Maria de Lourdes Freire Matos inside the 1st Guards Cavalry Regimentin the Federal District.
In addition to feminicide, the soldier must answer for the crimes of fire, firearm theft and procedural fraud, and could be sentenced to up to 44 years in prison.
O Military Public Ministry requested the conversion of the prison to preventive, highlighting the seriousness of the crimes and the risk to public order, discipline and the military hierarchy. Silva’s defense, in turn, claimed self-defense and asked for provisional release.
When deciding the case, the judge Frederico Veras concluded that there was strong evidence of materiality and authorship, reinforced by the confession and the evidence. He also said that the provisional release of the person being investigated would put the investigation at risk and would violate military hierarchy and discipline.
It was also cited by the previous magistrate of the STM (Superior Tribunal Militar) which authorize preventive detention in extremely serious cases.
The inclusion of the warrant in the National Prison Monitoring Bank was also determined and the judge informed the Federal District Jury Court about the competence of the Federal Military Justice to conduct the case.

. According to his testimony, the argument was motivated by “demands” from the victim, who allegedly wanted him to end his relationship with his girlfriend.
The soldier said that the corporal had drawn his firearm, but that he managed to divert the pistol and, with his other hand, reached for a knife that was on her waist, delivering a fatal blow.
Subsequently, Silva set fire to the space, causing a fire, which charred Maria de Lourdes’ body. In his version, he said that he tried to make the forensic work difficult and stole the victim’s gun to avoid collecting fingerprints.
The Fire Department was called to control the fire. After managing to put out the flames, firefighters found the charred body.
Silva’s arrest took place at his home, in Paranoá.
The soldier’s version, however, is contested by the corporal’s family and by soldiers who carried out the arrest. Witnesses say there was no type of relationship between the two and confirmed that Silva had a girlfriend who lived in his neighborhood.
