All workers have right to go on strike – which is a right provided for in the Portuguese Constitution. Whether or not they are unionized. In a general strike, any worker can join, regardless of their sector of activity, or whether they work in the public or private sector.
The worker does not have any mandatory to notify the employer of your participation in the strike. Nor is the boss supposed to ask questions; nor can it replace striking workers during the strike.
In relation to consequences, the worker who goes on strike does not receive a salary for the days on which he goes on strike; nor other benefits such as meal allowance. But being absent due to a strike does not affect the worker’s seniority.
In general, no worker can be harmed or discriminated against by the employer for joining a strike. If the employer does otherwise, it is a very serious offense.
