A car stopped due to lack of fuel on the highway represents more than a nuisance: it is a situation that is subject to serious administrative offences, with fines and additional sanctions, given the danger for those traveling on the highways.
The infraction is undue stopping
According to the Automóvel Club de Portugal (ACP), a website specializing in mobility and roadside assistance, it is not the end of fuel itself that constitutes a crime, but stopping the vehicle in a prohibited place.
The law considers that, when a car is immobilized due to lack of fuel on a motorway or similar road, the driver could, with minimal planning, have avoided the situation. The only legal exceptions to stopping on motorways are service areas, authorized parks and properly signposted emergency zones.
Fines and other consequences
The value of the fine for immobilizing the vehicle on the motorway without justification depends on the situation and the driver’s history, normally being between 120 and 600 euros, according to article 72 of the Highway Code. If the stop occurs on the carriageway, the fine may be even higher, reflecting the increased risk for other road users.
In addition to the fine, the law provides for additional sanctions that may prevent the driver from driving for a period of between one month and one year, depending on the severity of the case or if there is a repeat offense. These measures aim to prevent negligent behavior and reduce the risk of accidents, especially on high-speed roads, where any undue stop represents a significant danger.
Mandatory security procedures
If the vehicle is stopped, the priority must always be safety. It is important to pull over to the right, preferably on the side of the road or in an emergency area, turn on all four flashing lights immediately and put on a reflective vest before getting out of the car.
The warning triangle must be positioned so that it is visible from a long distance, ideally around 30 meters from the vehicle. Whenever possible, occupants should remain in a safe place, behind protective barriers, and only cross the road when the situation is properly controlled.
How to avoid the situation
Prevention involves simple care. Replenishing when the deposit reaches a room avoids having to resort to booking at critical moments. Before longer trips, it is useful to plan your route and know where the service areas are available for refueling.
Paying attention to the indicators and not relying solely on reserves helps to avoid most unexpected immobilizations and the risks they bring.

Answering a call or sending a message from the roadside is not permitted. Only situations of breakdown or accident justify stopping on the motorway.
