The senator (-MG) stated that there is excessive criticism directed at the minister of the (Supreme Federal Court) for having one of the lawyers involved in the Master case alongside him.
The former president of the House says he sees no basis in the criticism directed at the minister.
“The circumstance that the minister shared a private flight in the company of a lawyer does not make him suspect or prevented from judging cases that have that lawyer as a constituted patron, definitively,” said Pacheco, when questioned by the column about the topic.
“If that were the case, it would be very easy, for convenience or ruse, to generate suspicion or impediment of a judge to prevent him from judging a case”, added the senator, who did not want to comment on the merits of the case as he did not have access to the case files.
The senator added that “impediment and suspicion have their own strict discipline in the codes.” “That’s not the case,” he declared.
He also said he agreed with the fact that the Master case was in the STF and under secrecy. “If there is mention of an authority with jurisdiction and if the fact investigated is related to the national financial system, both the STF’s preliminary jurisdiction and secrecy are correct.”
Pacheco was one of the main names considered to be nominated by President Lula (PT) for the vacancy in the STF that was opened with the early retirement of minister Luís Roberto Barroso.
The senator, however, was passed over by the president, who nominated Jorge Messias, attorney general of the Union. The episode triggered a crisis between the PT member and the president of Pacheco and Pacheco’s ally, Davi Alcolumbre.
Toffoli traveled to watch the Libertadores final on Friday (28) in the morning, returning on Sunday (30) in a jet belonging to businessman Luiz Osvaldo Pastore.
In addition to Toffoli, among the more than ten passengers on the flight was former National Secretary of Justice Augusto Arruda Botelho, who currently advocates for one of Master’s directors and is a friend of the jet’s owner.
Master’s case at the STF was distributed to Dias Toffoli on Friday afternoon (28), after the minister’s departure for Lima. It is already pushing the defense of Daniel Vorcaro, owner of the financial institution.
