The president of the CCJ (Constitution and Justice Commission), (PSD-MA), announced this Wednesday (10) that senator Esperidião Amin (PP-SC) will be the rapporteur of the bill that reduces the penalties applied to those convicted in the coup plot processes that culminated in the attacks on the headquarters of Power on January 8, 2023.
The proposal (10), after an agreement between the center and the former president, one of those benefiting from the reduction in sentences.
Esperidião is a traditional right-wing senator who has moved closer to Bolsonarism in recent years. Now, he risks losing the group’s support in his quest for re-election in Santa Catarina.
The state, whose electorate votes mostly for conservative forces, is experiencing a dispute over who will be the candidates for senator in the Bolsonarist camp next year.
When announcing the name of Esperidião, the president of the CCJ said that the proposal should be voted on by the commission next week.
The president of , (União-AP), said on Tuesday that , but Otto Alencar protested. This Wednesday, at the CCJ, he repeated part of what he had said the day before:
“The Senate cannot, as it has been on some occasions, be the registry office of the Federal Chamber”, declared the president of the collegiate. The speech is to the effect that the senators needed some time to discuss the project. Otto’s position is supported by members of some of the House’s main benches, such as PSD and MDB.
Shortly after being announced, Esperidião also said that senators cannot be run over.
The proposal that reduces penalties was blocked for months in the Chamber because the PL insisted on a complete amnesty. The project moved forward after the Bolsonarist political group agreed to reduce punishments instead of forgiving them in full.
The vote took place in the early hours of the morning, after one of the deputy (-RJ) in the plenary — he occupied the table in protest against his impeachment process. It happened on the part of the legislative police.
The project will also have an impact on other criminals, with a faster regime progression for people found guilty of coercion during the process, arson and resistance against public agents, among other crimes, according to a technical study by three parties.
Left-wing deputies used the argument that the text would benefit organized crime to try to defeat it. In the plenary, the project’s rapporteur, deputy (Solidariedade-SP), denied: “The project only deals with the 8th of January, there is no possibility of this text benefiting common crime”.
The approval comes days after the senator (PL-RJ) pushed for amnesty in exchange for pardoning his father. The president of the Chamber, (-PB), however, said that he raised the issue of his own free will and not to respond to anyone’s request.
The text could reduce Bolsonaro’s prison time, as part of the coup plot, according to the rapporteur and opposition parliamentarians.

The leader of the PT in the Senate, Rogério Carvalho (PT-SE), protested against the project and mentioned Flávio’s pre-candidacy, despite not directly mentioning the senator’s name.
“All of this seems to me, it seems to me, I can’t accuse, that it is to respond to a pre-candidacy by Tarcísio de Freitas and someone withdraws the candidacy in exchange for the dosimetry, for the amnesty”, said Carvalho.
