PT leader will sue STF against Chamber decision that freed Zambelli from impeachment

The leader of the PT in the Chamber, deputy Lindbergh Farias, stated in the early hours of this Thursday (11) that he will file a writ of mandamus with the Federal Supreme Court against the decision that rejected the revocation of Carla Zambelli’s (PL-SP) mandate.

The Chamber of Deputies decided to maintain Zambelli’s mandate by impeaching the parliamentarian, imprisoned in Italy since July. To confirm the loss of the mandate, 257 votes were needed.

Lindbergh questions the decision, pointing out that the Legislative House should not have opened Zambelli’s situation to a vote, but merely determined the loss of his mandate. “The Supreme Court’s decision is clear. In Minister Alexandre de Moraes’ decision in sentencing Congresswoman Carla Zambelli, he cites article 55 of the Constitution, which states that the Board of the Chamber has to carry out the removal. We have been saying this for six months. It wasn’t even supposed to go to the CCJ”, he explains.

The plenary vote contradicted the decision taken hours earlier by the CCJ, which had recommended the impeachment with the support of deputies from the center. In 2022, Zambelli was the most voted woman in the country for the Chamber, with more than 946 thousand votes.

The PT leader in the Chamber reinforced that he will file the writ of mandamus so that the STF can decide again on the arrested deputy. Zambelli was sentenced to ten years in prison for hacking the National Justice Council system with hacker Walter Delgatti Neto.

According to the accusation, Delgatti issued a false arrest warrant against minister Alexandre de Moraes and had done so at the request of the parliamentarian. Zambelli denies having requested the action or participating in the preparation of the fraudulent document.

After his conviction, Zambelli fled the country. The deputy passed through Argentina and the United States before arriving in Italy, a country where she tried to take refuge because she had citizenship and was a supporter of the right-wing premier, Giorgia Melloni. She was arrested at the end of July following a court order.

Political dispute

During this morning’s session, Zambelli’s allies argued that the impeachment would be excessive and would signal the Chamber’s submission to the Judiciary. Deputies also recalled that, according to the Constitution, it is up to Congress to decide on the loss of mandate in cases of criminal convictions.
