Senate rapporteur points out “probability” of pro-amnesty amendments in the Dosimetry PL

The rapporteur of the Dosimetry PL in the Senate, Esperidião Amin (PP-SC), stated this Wednesday (10) that there is no legal impediment for senators to present amendments dealing with amnesty for those convicted of the acts of January 8, including former president Jair Bolsonaro, sentenced for an attempted coup.

The analysis of these suggestions, he said, will depend on the coordination of party leaders and the political climate in the CCJ.

Amin avoided predicting whether he would incorporate any of these provisions into the report, but acknowledged that the presentation of amendments is “very likely”. The contrast with the Chamber is evident: in the other House, attempts to include amnesty were blocked by rapporteur Paulinho da Força (Solidariedade-SP) or rejected in the plenary.

Now, the dispute reaches the Senate with an apparent greater margin for negotiation and with some senators expressing dissatisfaction with the size of the penalties established by the Federal Supreme Court.

The text approved by deputies in the early hours of this Wednesday changes the way in which the STF added up the convictions related to January 8th. Under the current rule, crimes such as coup d’état and violent abolition are counted separately.

The PL replaces this model by applying only the penalty for the most serious crime, with a limited increase. In practice, this logic substantially lowers the formal penalties, in the case of Bolsonaro, parliamentarians estimate a prison time of around 2 years and 4 months in a closed regime after readjusting the dosimetry.

The rapporteur should meet today with the president of the Senate, Davi Alcolumbre (União-AP), to align the schedule.

The initial forecast is that the opinion will be presented by Tuesday (16) and voted on by the CCJ on Wednesday (17). If there is sufficient consensus, the project could reach the plenary on the same day, fulfilling Alcolumbre’s promise to quickly move forward with the text after approval by the Chamber.
