Zambelli’s defense wants to use the decision of the Chamber in Italy – 12/11/2025 – Power

The congresswoman’s defense in Italy (-SP) argues that the decision not to impeach the congresswoman must be taken into consideration by the Court of Appeal in Rome, which will judge the extradition request made by Brazil.

This Wednesday (10) the plenary voted by 227 to 170 — 257 were needed to revoke her. The decision contradicted the determination of the Federal Supreme Court (), which sentenced her twice to loss of mandate, once for invasion of the (National Council of Justice) system, which resulted in 10 years in prison, and another for illegal possession to 5 years and 3 months in prison in an initial semi-open regime and to loss of mandate for illegal possession of a firearm and illegal constraint using a firearm. The sentence will still be made official with the publication of the trial ruling.

Zambelli has been imprisoned since the end of July in Italy, where she fled after being convicted. The next hearing in his extradition case is scheduled for December 18.

“If the highest political authority in Brazil states that Congresswoman Zambelli suffered injustice due to her political activities, how can the Court of Appeal in Rome not take this into account in its assessment of the extradition?” Sheet this Thursday the lawyer Pieremilio Sammarco, who defends the congresswoman.

“I think that this decision must necessarily influence the court, which has irrefutable proof of the political persecution suffered by the deputy and will be forced to deny the extradition,” he stated.

He also argued that the decision reinforces the report by deputy Diego Garcia (Republicanos-PR) presented to the Constitution and Justice Commission, which spoke of restrictions on Zambelli’s right to defense and signs of political persecution.

Last week, the parliamentarian’s defense requested that new evidence be included in the extradition process that would be favorable to her, including Garcia’s opinion.

Lawyer Alessandro Gentiloni, who represents Brazil through the (Advocacia-Geral da União), spoke out against the inclusion of the documents, arguing that they do not meet deadline and format standards.

The court’s decision on accepting the new papers will be known on the 18th. If they are accepted, the deadline for the start of the trial may be extended, so that the content can be evaluated. If they are rejected, the decision on extradition can begin to be defined in that same session.

The Italian Public Ministry has already declared itself in favor of extradition, as requested by Brazil. The body argues that all legal requirements exist to do so.

In recent days, the Italian Court sent a list of questions to Minister Alexandre de Moraes, of the STF, about the situation of Brazil’s prison system and the structure to which Zambelli could be sent. The step is standard in extradition processes. According to Agência Brasil, Moraes has until Sunday (14) to respond.
