Moraes gives Lava Jato court 24 hours to explain agreement – 12/11/2025 – Brasília Hoje

The minister of the (Federal Supreme Court) gave 24 hours for the 13th Federal Court of Curitiba to present information on the validation of an agreement between the Federal and confiscated items.

This agreement, which is being processed confidentially, was revealed by Sheet.

In the order, Moraes orders the court responsible for the proceedings to present information about the agreement, “widely reported by the national press, with the aim of distributing financial resources confiscated in the course of criminal proceedings related to illicit acts committed against the company Petróleo Brasileiro SA, Petrobras”.

The proposed agreement, which is being processed under secrecy, was presented to the Court by , and aims to unlock the release of resources.

These amounts are in offshore accounts in the principality that belonged to Duque. Previous court decisions determined that the money be sent to Petrobras, as the main victim of contract deviations.

Request from the Public Ministry addressed to the Federal Court of Paraná requested urgency in the assessment and deliberation of the draft of an agreement with Monegasque authorities so that part of the amounts would be transferred to Brazil and the other part would remain with the government of Monaco.

The allocation of these resources is already the subject of challenge, both in the first instance and in the TRF-4, but, so far, the resources have been denied, and the measure can be implemented immediately. The court reporter denied the embargo presented by the defense asking for the decision to be suspended just a few hours after the request was presented.

Previously, judges at the Lava Jato court in Curitiba had decided that the amount confiscated from Duque should be allocated to , the victim of the irregularities.

Both the judge at the time (now a senator for União Brasil-PR) and the magistrate (who was promoted and is now part of the Federal Regional Court of the 4th Region) made decisions in this regard.

Other agreements in the operation have already been the subject of controversy in the Supreme Court. In 2019, Moraes decided against the jurisdiction of the 13th Federal Court of Paraná in the United States.
