(from São Paulo) opened a process to terminate the contract with the foundation responsible for TV Alesp, which is accused by employees and former collaborators of delaying salaries and not paying the termination fines for dismissals.
Since 2011, TV Alesp has been managed by Fundac (), a private, non-profit entity. For the first time since taking over the House’s communications, the producer was disqualified from a auction last month, and will end its work in the Assembly at the beginning of next year.
The current contract, signed in March 2023 for the value of R$30 million, was updated to R$42.9 million after being extended twice. It ends on January 30, 2026.
“At the end of January 2026, the legal duration of the contract between Alesp and the foundation will expire. In other words, the contract will be executed in its entirety until the end”, stated the Assembly’s communication in a note.
Employees consulted by the report said that the contract should come to an end with the process still ongoing, being closed not due to internal determination, but rather due to the fact that Fundac did not win the last bid.
The process for termination was announced by the General Secretariat of Administration, responsible for Alesp’s contracts, in the Official Gazette on December 1st. The justification is that the producer has had part of the mandatory documentation expired since November 2024 — in this case, the Labor Debt Clearance Certificate, a document that certifies the absence of debts with the Labor Court.
Alesp announced, also at the beginning of the month, that it will impose a fine of R$12,700 on Fundac for failing to present the documentation, which was stipulated in the contract and had been charged since April this year. The producer did not respond to contact attempts made by the reporter via email and telephone.
Subject to reservation, former employees and collaborators who still work for the foundation. Complaints include lack of payment of credits for transportation vouchers and meal vouchers and delays in installments since last year.
The cases are not only reported in São Paulo, but also in Brasília, at the Federal Supreme Court, also managed by Fundac. In both cities, employees of the production company denounced irregularities in payments to the unions of journalists and broadcasters.
In July, less than two months after the broadcast of the coup plot, employees of TV Justiça in Brasília approved a state of emergency — which signals the category’s intention to paralyze activities if negotiations involving labor rights do not advance. However, no strikes have occurred to date.
In addition to Alesp and the STF, Fundac maintains contracts with the (Superior Electoral Court) and . In São Paulo, the producer has 120 professionals hired. In Brasília, the foundation says it employs 500 people.
Exempted from bidding on its first contract by Alesp, since 2013 Fundac had been winning all of the Assembly’s competitions. She was disqualified from the most recent auction, in November this year, for failing to present a certificate issued by the federal government to non-profit organizations. In the dispute, the producer questioned the obligation of the document.
The winner of the competition was EPTV from São Carlos, which is part of the group responsible for TV Globo affiliates in the interior of São Paulo and in the south of Minas Gerais. The contract, initially worth R$26.9 million, is still being evaluated.
Fundac employees are concerned that the company does not have the money to cover possible layoffs, since EPTV’s cost spreadsheet, if it is accepted, foresees 103 job vacancies, that is, 17 fewer people than TV Alesp’s current staff.
In April 2023, the Sheet published that the then president of Fundac, Ricardo Castilho, amid suspicions of diversion of funds from the entity’s coffers estimated at R$3.5 million through an “orange” company.
