The Minister of the Federal Supreme Court (), voted this Tuesday (16) to acquit delegate Fernando Oliveira, from the Federal Police (PF), and convict five more defendants in the case of the so-called coup plot. They are accused of being part of a criminal organization to keep former president Jair Bolsonaro in power after the 2022 elections. They are part of what was called Nucleus 2, a kind of second level in importance in the plot.

The mission of this group was to monitor and neutralize authorities, according to the Attorney General’s Office (PGR). Furthermore, they also sought to prevent voters from reaching the polls during the 2022 elections, using the PF apparatus, mainly in the Northeast. They would also be responsible for preparing the so-called “coup draft”, which would be used by Bolsonaro to justify the stadium siege.

Moraes voted to acquit Fernando Oliveira, a PF delegate and former executive secretary of the Public Security Secretariat of the Federal District. He was accused by the PGR of coup d’état, abolition of the Democratic Rule of Law, qualified damage through violence, serious threat and deterioration of listed property.

The minister, rapporteur of the case, voted to convict four defendants for these crimes:

  • Filipe Martins, former International Affairs advisor to former president Jair Bolsonaro;
  • Marcelo Câmara, former advisor to Bolsonaro;
  • Silvinei Vasques, former director of the Federal Highway Police (PRF);
  • Mário Fernandes, Army reserve general;

For Marília Alencar, former director of Intelligence at the Ministry of Justice, Moraes voted to convict her for only two crimes: attempted violent abolition of the democratic rule of law and criminal organization. Flávio Dino, Cármen Lúcia and Cristiano Zanin still have to vote.
