Dosimetry PL is on the agenda of the CCJ and the Senate plenary this Wednesday

Target of resistance and negotiations by senators, the so-called Dosimetry PL will be analyzed in this Wednesday (17). In the morning, the project is discussed at the CCJ (Constitution and Justice Commission) and, in the afternoon, it is also on the plenary agenda.

On Tuesday (16), the president of the Senate, Davi Alcolumbre (União-AP), reinforced that the proposal would go to a vote. He announced, last week, that he had a “commitment” to vote on the proposal by the end of the year. The text reduces sentences for those convicted of the coup plot, including former president Jair Bolsonaro (PL), and for acts of January 8.

The target of criticism, the proposal was the subject of a series of meetings in recent days. Some senators argue that the project could open loopholes to benefit those convicted of other crimes. The MDB bench decided to take a stance against the project.

The PL Antifaction rapporteur, senator Alessandro Vieira (MDB-SE), presented a separate vote for the total rejection of the text. According to him, the project has “insane defects” and “disastrous side effects that will benefit common and organized crime”.

Dosimetry rapporteur, senator Amin Esperidião (PP-SC) articulated changes to resolve criticism of the text about benefiting other convicts. The changes were negotiated with House leaders and members of the CCJ. An alternative evaluated is to adopt an amendment proposed by senator Sergio Moro (União-PR).

“I am working to present a free project, free from any accusation of benefiting others other than those convicted in the January 8 process. No one will be able to say that this is to benefit a crime of this, a crime of that”, said the rapporteur to the journalist in the Senate on Tuesday.

In practice, the Dosimetry PL provides for the possibility of regime progression after serving one-sixth of the sentence and establishes higher percentages depending on each case.

The text, however, contradicts excerpts from the Antifaction PL, which was approved in the Senate and returned for analysis by the Chamber. While the Antifaction project tightens rules, the dosimetry project maintains or makes legislation on serving sentences in a closed regime more flexible.

Initially, the proposal aimed at a broad amnesty defended by the opposition, but the rapporteur in the Chamber, deputy Paulinho da Força (Solidariedade-SP), proposed a reduction in the calculation of penalties and dubbed the proposal the “Dosimetry PL”.

After months of negotiation and pressure, the matter was voted on by the Chamber last week, in a session that lasted until the early hours of the morning. The government base was against the matter. Last Sunday (14), left-wing protesters carried out demonstrations against the Dosimetry PL in the country’s capitals.

Defenders of the proposals, in addition to aiming for approval in the Senate, hope that the text will not need to return to the Chamber. after undergoing adjustments. Thus, the text could go directly to presidential sanction. President Luiz Inácio Lula da Silva (PT) indicated to assistants that he could veto the project. In this case, Congress will have the final say in overturning or maintaining the veto.
