Dallagnol pays compensation to Lula for PowerPoint case

The former public prosecutor paid compensation of R$146,800 for moral damages to President Luiz Inácio Lula da Silva (PT) in . The amount was deposited in an account linked to the São Paulo Court of Justice (TJ-SP) and will later be transferred to Lula, including the president’s legal fees.

In July, the TJ-SP ordered the former coordinator of Operation Lava Jato to make, within a period of up to 15 days, the payment of R$ 135.4 thousand to Lula, as compensation for moral damages, as a result of the publication of the PowerPoint presentation used to illustrate the denunciation of the Guarujá triplex case, in 2016.

According to the order to comply with the sentence, issued by judge Carlo Brito Melfi, failure to comply with the deadline could result in the imposition of a fine of 10% of the amount owed, in addition to legal fees also set at 10%.

The deposit in the amount of R$146,847.13 was sent on November 27th. The reporter had access to the bank receipt this Friday, the 19th.

In a video published on social media in November this year, Dallagnol stated that he had received donations via Pix from more than 12 thousand people. According to him, the amount raised, after investment in financial investments, totaled around R$835 thousand. Also according to the former prosecutor, the excess amount, approximately R$688 thousand, was allocated to philanthropic hospitals that care for children with cancer and Autism Spectrum Disorder (ASD).

Corrected value

The compensation had initially been set at R$75,000 by the Superior Court of Justice (STJ), in 2022, but was later updated with monetary correction and application of interest. At the time, the ministers concluded that there was an “excess” in publicizing the complaint against Lula and that Dallagnol offended the honor and reputation of the then former president. The trial ended with a score of 4 votes to 1.

Lula appealed after having his request for compensation for moral damages denied in the first and second instance decisions. In the action, the PT member requested the payment of R$1 million.

Remember the case

In a press conference held in September 2016, then prosecutor Deltan Dallagnol used a PowerPoint presentation to highlight images and graphics that pointed to Lula as the center of a criminal organization responsible for embezzlement of public resources at Petrobras.

At the time, Dallagnol stated that the bribe intended for the former president would exceed R$3 million. On the same day, the Lava Jato task force formally denounced Lula, former first lady Marisa Letícia, the president of the Lula Institute, Paulo Okamotto, businessman Léo Pinheiro, from OAS, two employees of the construction company and two others under investigation.

“I would do it again a thousand times”

Deltan Dallagnol stated, in July this year, when commenting on the conviction, that he would do PowerPoint again “a thousand times”. In a post on social media, he said he would once again “put those against whom strong evidence of corruption appears in jail and not in the Presidency”.

“I did the right thing, I have no regrets, and those who should be condemned are the corrupt and those who guarantee them supreme impunity”, stated Dallagnol when commenting on the decision.
