Prosecutor’s Office points out serious flaws in the service and demands clarification on possible renewal of the concession during the rainy season
The City of , through the Municipal Attorney General’s Office, filed this Thursday (18) an urgent request, published this Friday (19), requesting a subpoena from the National Electric Energy Agency (Aneel). The municipality demands that the regulatory agency bring forward the final decision on the decree of expiry (cancellation) of the concession contract, discarding the initial deadline that predicted the completion of the analysis only by March 2026.
In the document, the City Hall formally questions whether Aneel is still considering bringing forward the extension of the contract with the distributor, despite the history of deficiencies in service provision. The text cites the “undeniable failures” that occurred during the weather event on Wednesday, December 10th, and recalls statements by the Minister of Mines and Energy, who has already indicated that there are legal grounds for breaking the contract.
Imminent risk
The urgency of the request is justified by the beginning of the wet season in the capital of São Paulo. According to the Prosecutor’s Office, there are “robust chances” of new extreme weather events, which exposes the population to serious social and economic losses if the provision of energy services is not regularized or monitored with immediate rigor.
In addition to defining the contract, the municipality requires the presentation of documents that would be missing in the administrative process (Intimation Term nº 49/2024), including technical notes, memoranda and inspection reports referring to the measures adopted by Enel between November 2024 and January 2025.
The petition also requests that any request for confidentiality in the process be rejected. The municipality argues that Aneel’s Board of Directors, in a meeting held in November this year, had already decided to publicize the files, reinforcing the need for transparency in negotiations involving the concession of electricity in the city.
The request is now awaiting court order so that the summons can be issued by a court official with “maximum urgency”.
