The government placed in 77 requests made based on the nature of personal data, says the (Comptroller General of the Union).
This number represents 0.063% of the 122 thousand requests responded, according to the agency.
The denial of personal data in requests made based on the LAI represented 1.05% of this total. The percentage is the result of changes in the application of personal data confidentiality, states the CGU.
In September 2024, the Comptroller’s Office, with the aim of ending the hundred-year secrecy.
The published ordinance indicates that, if there is no indication of the period for restricting access to personal information in a decision, the standard period adopted will be 15 years, maintaining the maximum limit only for specific, justified situations with continuous monitoring.
The change does not exclude the possibilities of secrecy for up to one hundred years. This period is provided for in article 31 of the LAI and can be applied to cases containing personal information, “relating to intimacy, private life, honor and image”.
Until June 2025, the Fala.BR system did not have a field indicating the term of the restriction and automatically adopted one hundred years.
In 2024, under the previous understanding, 1,916 denials were registered, classified as confidential for one hundred years, corresponding to 19.53% of the total number of denied requests. During the year, the total percentage of refusals was 1.69%. In 2023, negatives represented 1.05%, the same percentage as this year.
