US tariffs on semiconductors from China will remain at 0% until June 2027 under a new trade action, according to a notice released by the Office of the US Trade Representative (USTR), which details the measures adopted following an investigation conducted under Section 301 of the Trade Act of 1974.
Section 301 is an instrument of US trade law that authorizes the US government to investigate foreign practices considered unfair and to impose measures such as tariffs in response.
According to a document to be published next Monday, 29, in the Federal Register, the official US journal, the American response includes “the adoption of tariff action now on semiconductors from China, with an initial tariff level of 0%”. The text clarifies that this new rate “will increase in 18 months, on June 23, 2027, to a rate to be announced”, which must be announced “no less than 30 days before that date”.
The USTR says it has determined that China’s practices related to driving the semiconductor industry toward dominance are “actionable” because they are considered “irrational” and “burden or restrict U.S. commerce.”
The notice highlights, however, that this new tariff action will be in addition to the already existing 50% tariffs on Chinese semiconductors, imposed in a previous investigation linked to forced technology transfer. Therefore, the 50% tariff remains in force, while the new measure comes into force this Tuesday, with an initial rate of 0%, and will be implemented through changes to the United States Harmonized Tariff Table.
