The conviction refers to a post from October 2023. At the time, the deputy published a photo of Andreone with phrases that associated the psychologist’s presence in women’s bathrooms with risks, using terms that the Court considered offensive. “Woe to you if you complain if a black guy like that comes into your daughter’s bathroom, right? Because then you, my brother, will create a big problem, you’ll be homophobic”he wrote.

During the process, Nikolas Ferreira’s defense said that there was no illegality in the conduct. Lawyer Thiago de Faria stated that the publication was political in nature and would be protected by parliamentary immunity, a thesis that was not accepted to avoid conviction.
