The CNI (National Confederation of) asked the Planalto Palace that Lula (PT) veto three points from the tax benefits of companies and (betting houses), fintechs and JCP (Interest on Own Capital).
The and by the Senate on December 17, in the last session before the parliamentary recess. In the technical note sent to the Civil House, the CNI suggests a veto on central points and states that sanctioning the project in its entirety will bring serious losses to the industry.
The confederation asks Lula to veto the reduction of federal tax incentives by 10%; the increase in JCP taxation from 15% to 17.5%; and the increase in the presumption rate for companies under the presumed profit regime with annual revenues above R$5 million.
“In practice, considering the publication of the law in 2025, the reduction will take effect from January 1, 2026 for various incentives, which creates serious legal uncertainty for companies”, states the CNI in the document.
The CNI had already protested during the vote on the project in Congress, without success. The change, according to the federal government, should avoid a spending cut of more than R$20 billion in the 2026 Budget — which would also affect parliamentary amendments.
The rapporteur of the project in the Chamber, Aguinaldo Ribeiro (PP-PB), says that he calculates that the impact next year will be R$ 17.5 billion in revenue recovery, R$ 2.5 billion in tax increases with the change in JCP taxation, R$ 1.6 billion with fintechs and R$ 850 million with bets.
The president of the CNI, Ricardo Alban, says that “the sector can no longer bear so much burden”. “This project is completely excessive and unreasonable, as it imposes losses on Brazilian industry, which is already losing competitiveness year after year”, he states.
