The revelation that the minister traveled to Peru for the Libertadores final generated criticism about a possible conflict of interests for the magistrate.
Toffoli is the minister responsible for the case of banker Daniel Vorcaro, owner of Banco Master, in . Four days after the trip, he declared maximum secrecy over the process, even restricting the viewing of procedural movements.
Afterwards, decisions were made on the progress of the investigation. He became responsible for authorizing requests for information and breaches of confidentiality, in addition to the evidence seized in the case.
On the 24th, the minister ordered a confrontation between Ailton de Aquino, director of Inspection at , Paulo Henrique Costa, former president of BRB (Bank of Brasília) and Daniel Vorcaro.

Opening of the fake news inquiry
In March 2019, in a context of Bolsonaro mobilization against the court and its members, Toffoli decided, an investigation conducted by the court itself to investigate attacks and threats against the Supreme Court
To this end, the judge invoked article 43 of the STF regulations, which provides for the possibility of opening an investigation when a crime is committed on the court’s premises. In practice, however, the investigation, which is still ongoing, dealt with threats and attacks on internet publications.
To conduct the inquiry, Toffoli appointed minister Alexandre de Moraes, contradicting the principle of distribution by lottery, which normally governs court procedures.

Massive Lava Jato cancellations

In June 2024, the Sheet revealed that the STF paid R$39,000 to a security guard for minister Dias Toffoli in international daily allowances for a trip to the United Kingdom that included the magistrate’s trip to the final.
The security guard received the fees to accompany Toffoli from May 25th to June 3rd. Public resources were cut off for a security guard to accompany Toffoli at events held in London, in the United Kingdom, and Madrid, in Spain, weeks earlier.
