To carry out the interventions, the former president was temporarily removed from the Federal Police Superintendence in the federal capital, where he is serving a sentence of 27 years and 3 months in prison for an attempted coup. In the decision, Moraes highlighted that Bolsonaro is subject to an exceptional custody regime during hospitalization, different from that applied in the prison system.

According to the minister, the former president must follow the rules specific to the hospital environment and medical guidelines, which imposes additional restrictions. “Given the exceptional circumstances of hospital admission, the need to guarantee safety and discipline, I reject the request made”, wrote Moraes. The decision also prevents the father of former first lady Michelle Bolsonaro from visiting for the duration of his hospitalization.
