House arrest for Jair Bolsonaro is further away

STF (Supreme Federal Court) minister Alexandre de Moraes denied for the third time the request for house arrest for former president Jair Bolsonaro (PL). The decision was taken after Bolsonaro returned from a hospital stay, where he underwent medical treatment. The investigation was carried out by CNN political analyst Jussara Soares during the CNN Prime Time.

In the decision, Moraes highlighted two main points to justify: the risk of escape, which had already been mentioned when he ordered the arrest in November, and the improvement in Bolsonaro’s health, contrary to what was alleged by the defense.

The expectation is that Bolsonaro’s defense will continue to request house arrest, but the possibility of a change in Moraes’ stance is considered very distant. “In the short term, at least that’s the perception here in Brasília”, explained Jussara.

Conditions of detention and arguments for the decision

highlighted that Bolsonaro is detained in a General Staff room at the Federal Police Superintendence in Brasília, where he has access to a bed, television and medical assistance 24 hours a day. The minister stated that everything recommended by doctors can be carried out at the place of detention.

Another argument used by Moraes was that the criterion of humanitarian house arrest is not automatic and must meet a series of requirements that, in the minister’s assessment, are not met by Bolsonaro.

This is Alexandre de Moraes’ third denial to . The first occurred in November, when the minister decreed preventive detention. The second was on December 19, when he authorized Bolsonaro’s surgery, but denied house arrest. The new decision keeps Bolsonaro in the Federal Police Superintendency, where he has remained since he was detained.
