Minister Alexandre de Moraes, of the Federal Supreme Court, ordered, this Monday (5), to send a letter to the Federal Police to clarify the allegation presented by the defense of former president Jair Bolsonaro about alleged discomfort caused by the noise of the air conditioning in the cell where he is serving his sentence, at the PF Superintendence in Brasília.
The statement is contained in an order within the scope of the criminal execution resulting from the criminal action that resulted in the .
In the petition filed on January 2, 2026, the lawyers state that, despite the former president being confined in the General Staff Room — a condition already guaranteed by decision of the STF —, the environment would not guarantee “minimum conditions of tranquility, rest and preservation of health”.

According to the defense, the problem would be related to the proximity of the cell to the unit’s central air conditioning equipment, which would cause hearing discomfort for the former president.
In the request, the lawyers requested that technical measures be adopted to solve the supposed problem, citing alternatives such as adapting the equipment, acoustic insulation, changing the layout or another equivalent solution, in order to ensure adequate conditions for staying at the location.
When analyzing the request, Moraes did not determine any immediate measures, but ordered the forwarding of a copy of the petition to the Regional Superintendency of the Federal Police in the Federal District. The body must provide information on the conditions reported by the defense within five days.
Only after the Federal Police demonstrates will the minister assess whether there is a need for new determinations regarding the fulfillment of the former president’s sentence.
