BC appeals to TCU against individual minister’s order to inspect accounts

The (BC) filed an appeal on Monday (5) with the Federal Audit Court (TCU) challenging the legality of the monocratic decision handed down by minister Jhonatan de Jesus. The magistrate had determined, individually, to carry out an inspection of the monetary authority’s premises.

In the document, legally classified as a motion for clarification, the BC Attorney General’s Office argues that the internal regulations of the Court of Auditors do not support inspection orders issued in isolation by a rapporteur. According to the authority, procedures of this nature require collegial deliberation and must pass through the review of the Court’s Chambers to be valid.

The focus of the dispute is the opening of an audit into the BC’s internal processes that culminated in the extrajudicial liquidation of . The inspection was administratively authorized by the president of the TCU, Vital do Rêgo, following an order from Jhonatan de Jesus, who pointed out the need to verify the regularity and coherence of the decisions taken by the monetary authority in the case.

In its defense, the Central Bank requests that the reporting minister submit the request for inspection to the First Chamber of the TCU. The objective of the appeal is to remedy what the BC classifies as a procedural “omission”, ensuring that the measure is validated by the competent panel, as stipulated by institutional rules, before any investigation into the institution’s confidential documents.
