New rule prevents charges even with authorization from the insured, determines reimbursement within 30 days and provides for active search for retirees and pensioners injured by undue discounts
O sanctioned the law that prohibits discounts on association monthly fees in benefits administered by the. The new legislation also determines the active search for beneficiaries injured as a result of undue discounts and provides for their compensation.
The change, promoted in the Social Security Benefit Plans Law (Law 8,213/1991), prohibits discounts even with the express authorization of the beneficiary, assigning the obligation to reimburse undue discounts to the association or financial institution within 30 days. The exception is for prior, personal and specific authorization, with biometric authentication, facial recognition or fingerprint and electronic signature.
The new law was published in the Official Gazette of the Union this Wednesday (7) and also regulates the seizure of assets of people investigated or accused of crimes related to undue discounts on INSS benefits.
The debate that resulted in the change in legislation began after the Federal Police (PF) and the Comptroller General of the Union (CGU) launched Operation Without Discount, in April 2025.
The investigation made public the existence of a scheme that harmed millions of INSS beneficiaries throughout Brazil. Since then, all technical cooperation agreements that allowed associative monthly payments directly into benefits have been suspended. A task force was started to return the amounts to the injured pensioners.
According to the latest INSS balance sheet, as of January 5th, R$2,835,784,151.87 had already been reimbursed to victims of irregular discounts on monthly fees charged by associations, unions, class entities and organizations in social security benefits. The value corresponds to 4,160,369 dispute requests submitted by retirees and pensioners who questioned the irregular discounts.
More than 72.5 million queries about undue discounts were registered on the Meu INSS application, of which 38.7 million confirmed the non-existence of the discount. There are still more than 6.3 million dispute requests open. 131,715 cases of undue discounts have already been recognized.
