Centrals see setback in law that vetoes INSS discount – 01/08/2026 – Panel

They called the law sanctioned by President Lula (PT) a social setback, which was sanctioned this Wednesday (7) and responded to the scandal.

The position is supported by CUT (Central Única dos Trabalhadores), Força Sindical, UGT (União Geral dos Trabalhadores), CTB (Central das Trabalhadoras do Brasil), NCST (New Central Sindical de Trabalhadores) and CSB (Central dos Sindicatos Brasileiros).

The entities claim that the law suppresses a right historically won by retirees and pensioners, guaranteed since the 1988 Constitution. “This is a serious social setback, as it extinguishes a historic achievement consecrated by the ‘union citizenship’ of retirees and pensioners”, they argue.

“By preventing the authorized discount, the project condemns these workers to invisibility and the denial of social protagonism, limiting their ability to organize, form unions and participate in social struggles, including the management of Social Security.”

For the entities, the law has “a clear anti-union nature, as it restricts the fundamental right to free union organization of inactive workers”.

The centers state that the law is not restricted to associations of pensioners and retirees, but covers any union or association. “In other words, anyone removed by the INSS will not be able to contribute to their union or association, due to legal prohibition. It is clear that this is an unconstitutional measure, which violates union autonomy”, they argue.

They also say that the law will lead to financial suffocation and the weakening of entities representing retirees, compromising their survival.

They also see a “classist and discriminatory nature” in the law, as it authorizes the INSS to make discounts on retirees’ benefits when it comes to payroll loans, maintaining and expanding this modality, while prohibiting associative discounts, even when authorized.

“Such asymmetry violates ethical and public administration principles, favoring the continuity and expansion of the supply of credit granted by the financial system, to the detriment of the union autonomy of retirees”, they say.
