The Minister of the Federal Supreme Court () annulled the Federal Council of Medicine’s determination to establish an investigation to investigate the medical care provided to the former president last Tuesday (6), alleging “flagrant illegality and misuse of purpose”. Furthermore, he also summoned the president of the CFM to a hearing in order to explain the “illegal conduct”. According to the minister, the request is illegal and does not fall within the competence of the CFM, in addition to stating that the council demonstrates “total ignorance of the facts”. The CFM stated in a note last Tuesday (6) that a “continuous and immediate monitoring protocol” should be adopted, something that Moraes reinforced is already in force.

“In a decision issued on 11/22/2025, I determined the provision of full-time medical care to the defendant JAIR MESSIAS BOLSONARO, which guaranteed his prompt care by the Federal Police medical team, which considered the absence of need for immediate removal of the person in custody to the hospital”, says Moraes in the decision.

Still according to Moraes, “there was, therefore, no one who acted correctly and competently, as corroborated by the medical examinations carried out on the custodian today, at the DF Star Hospital, which did not indicate any problem or sequelae in relation to what happened in the early hours of the previous day”.

In addition to the annulment, Moraes also summoned José Hiran da Silva Gallo, president of the Federal Council of Medicine, for a hearing, with the aim of explaining the “illegal conduct” of the CFM in the case and to determine possible criminal liability. The hearing must take place within a maximum period of ten days.

Furthermore, Moraes determined that the Director of the DF Star Hospital, Alisson Barcelos Borges, where Bolsonaro underwent exams this Wednesday, send all medical exams and reports referring to the former president within 24 hours.
