Amin files amnesty project for those convicted on 1/8 – 01/08/2026 – Panel

Senator Esperidião Amin (PP-SC) filed this Thursday (8) a project that calls for amnesty for those involved in the 2023.

The senator was the rapporteur in the House of the bill during the demonstrations three years ago. He had announced that he would present a text for amnesty in the event of a veto by President Lula (PT) –.

“Dosimetry is the minimum to reduce tension in the country. And amnesty is a commitment to pacification. I never agreed that dosimetry was the solution to face what happened on January 8th,” the senator told the column.

In his project, Amin asks for amnesty for those prosecuted or convicted in the (Supreme Federal Court) involved in , as long as their conduct has a political or electoral motivation.

In justification, the senator states that a highlight approved in the 1988 Constituent Assembly provides for the possibility of amnesty for crimes committed against the constitutional order and the democratic rule of law.

The senator says in the proposal that the paragraph was approved by politicians such as the former president (PSDB) and Lula.

“Lula made an incoherent and controversial political decision [ao vetar a redução de pena no 8/1]. Incoherent because he voted in favor [do destaque na Constituinte]. He voted in favor of not banning the amnesty,” says Amin.

The senator stated that, in addition to asking for amnesty, he will also vote to overturn the president’s veto on the so-called Dosimetry PL.

When the project was under his rapporteurship, he presented a drafting amendment (which does not change the merit of the proposal) to restrict the reduction of sentences only to those involved in the January 8 attacks.

The alternative made it possible for the project to be approved in Congress last year, without having to return for analysis by the Chamber.

“I have no doubt that in the end we will overturn the veto and the Supreme Court considers that Congress changed the direction of things [com a emenda de redação]”, says Amin, who defends his text.
