The Court of Justice recognized, this Monday (12), that the City of São Paulo can retake the land where Container operates, in Luz, in the center of the capital of São Paulo.
In a letter, judge Nandra Martins Da Silva Machado says that the deadline for Companhia Munguzá to leave the space, which is public and occupied by the theater group since 2016, has already passed.
According to the judge, “it is a fact that once the period of permanence granted by the E. Court of Justice has ended, there is no obstacle to preventing the Municipality from repossessing the property, given that it is acting in accordance with its property rights.”
In the text, Machado also mentions the , when the municipal administration filed an eviction action. According to the City Hall, the space will be used for the construction of social housing.
“It should not be forgotten that the Court is fully aware that the plaintiff apparently is not moving to leave the public property and understands the defendant’s concern in repossessing the property, but despite the repercussion and importance of the case, the request made effectively goes beyond the object of the case.”
In December, the Panel reported that residents of a condominium and other properties in the center sent a petition to the Ricardo Nunes (MDB) management for the theater in the region.
