A new request was filed by the reserve captain’s lawyers this Tuesday (13)
Previously considered “buried” by interlocutors of the Federal Supreme Court (STF) and even by right-wing politicians, the possibility of humanitarian house arrest for former president Jair Bolsonaro was once again discussed behind the scenes this week.
A new request was filed by the reserve captain’s lawyers this Tuesday (13) following the incident suffered by the former president inside his cell at the Superintendence of Brasília, on the 6th. According to the medical team, he suffered a “mild head trauma”.
The Federal Police provided first aid and declared that they had not identified the need for hospital referral. On the morning of the following day, however, the minister responded to the defense’s request and allowed Bolsonaro to go to the hospital to undergo tests. He was released a few hours later and returned to the PF.
According to Bolsonaro’s defense request, the fall changes the scenario that supported the last denial, on January 1st. The lawyers also claim that the former president, according to a physiotherapeutic report, “cannot stand on his own”.
The strong reactions from the right to Bolsonaro’s fall, led by former first lady Michelle, sparked an alert in the Judiciary, which once again discussed granting humanitarian house arrest to the former president. The consensus is that a worsening of Bolsonaro’s health condition in PF custody would help to deteriorate the image of the STF, the federal government and the Federal Police itself in the eyes of part of the public opinion, in addition to validating the Bolsonaro narrative that the former president would be a victim of “persecution” and “torture”. The episodes of hiccups, dizziness and hallucinations reported by the former president are also worrying.
Around Bolsonaro, there is “hope”, according to a source heard by the column. Still according to the former president’s allies, the debate heated up again precisely after the fall of the reserve captain.
According to senator Izalci Lucas (PL-DF), the Upper House helps in the negotiations: according to the congressman, the gesture on the part of the STF would help to “seal peace” between the Legislature and the Judiciary.
The biggest obstacle remains the same one that put Bolsonaro in the PF cell: the use of a soldering iron to try to break the electronic ankle bracelet. The expert’s conclusion is that the former president used the tool for “directed heating for opening”. As a result, the risk of flight could be used as an “infallible argument” to deny Bolsonaro’s return home, according to Supreme Court sources.
The decision would necessarily have to come from Moraes, considered Bolsonaro’s executioner. The minister has a history of harsh decisions against the former president and his allies. He is also the biggest target of accusations of persecution, even being called a “dictator” by allies of the former president. It became the target of the Magnitsky Law, imposed by the USA after the insistence of deputy Eduardo Bolsonaro (PL-SP). According to sources heard by the column, it is difficult to imagine the minister having “goodwill” with the reserve captain.
